Public Defense Day

March 18th marks Public Defense Day-- a powerful reminder of the Supreme Court's landmark decision in Gideon v. Wainwright. The day is an opportunity to honor the important role public defense plays in fulfilling our nation’s promise that justice is not reserved for the powerful or wealthy but guaranteed to all.

Public defenders, court appointed counsel, and the professionals who stand beside carry this constitutional promise forward every day. Their dedication strengths public safety, promotes public trust, and demands that outcomes are based on facts, evidence, and the law, rather than circumstance, conjecture, or popularity.

Public Defense Day is a call to acknowledge and celebrate the essential work of those who keep Gideon's promise alive. Join NACDL in honoring their resilence, sacrifice, and steadfast commitment to equal justice under the law by showing your support.

Attend the Webinar - A Path Forward: Transforming the Criminal Legal System Through Public Defense

Register to attend on March 17

While the failings of our legal system are well documented, there is a pathway forward. Centering on the experiences of public defense lawyers and the communities they serve, join us for a compelling coversation with Emily Galvin Almanza, author of The Price of Mercy: Unfair Trials, a Violent System, and a Public Defender's Search for Justice in America. Together we will explore tangible, proven ideas that can help transform our criminal legal system and examine the pivotal role public defenders play in advancing justice.

Facilitated by Washoe County Deputy Public Defender Jennifer Rains, this frank and solution-focused discussion will confront where we are today, envision where we want to be, and - most importantly- chart practice steps for how we can get there. Grounded in real-world experiences, the program will be a critical conversation on how we can construct a better future.

The History of Public Defense

While the history of the right to counsel did not begin with Clarence Earl Gideon's petition to the Supreme Court, his case embodies why having access to a skilled, trained, and committed advocate matters. Forced to represent himself at trial, in 1961 Gideon was convicted of breaking and entering in a Panama City, Florida, court. However, following the Supreme Court's ruling that Gideon was entitled to representation, in 1963 he returned to that very same courtroom for a retrial. This time, with an experienced defense lawyer to assist him, Gideon was acquitted of the charges. Want to read more about Gideon's story, see the trial transcripts, and learn about Bruce Jacob, the young Florida Assistant Attorney General who argued against Gideon in the Supreme Court, that went on to be honored by NACDL in 2013 as a Champion of Public Defense?

Just like the history of the right to counsel did not being with Gideon, the origin of the institutional public defender's office, does not being with the Supreme Court's 1963 decision. More than 50 years before Gideon's trial, Clara Shortridge Folz, one of the country's first women lawyers, shared her vision for an institutional defender office that would mirror the model of the government-funded prosecution, thereby providing a more level playing field by ensuring that every person, regardless of means, would have a skilled and resourced advocate by their side. Learn more about this pioneering hero and the important role women play in protecting the right to counsel.
