United States v. Ortiz

A DHS agent was assisting other agents in moving a vehicle through protestors, defendant was obstructing the officers and waving a black flag in protest. According to an agent, in the process of waving the black flag, the flag struck the agent in the vicinity of his face. Defendant was charged with simple assault, a misdemeanor, but less than a month later, the government moved to dismiss the information without prejudice.
