United States v. Kirk

In June 2023, defendant, a deputy sheriff in the LA County Sheriff's Department, was accused of use of excessive force--body-slamming the victim to the ground face-first and using pepper spray multiple times against the victim, causing bodily injury and extreme physical pain to victim who had been videotaping the deputy sheriff as he was making an arrest of her companion. Defendant was convicted by a jury following a three-day trial in February 2025. The government later sought to alter the outcome of the trial by moving to dismiss the elements that made the offense a felony.
