United States v. Jose Roberto Ramirez

Agents stopped a vehicle driven by defendant, allegedly because he was a person with a removal order. In fact, he is a US citizen of Native-American and Hispanic descent. After the stop, agents reached into Ramirez's car, grabbed his phone, and an altercation ensued. Defendant alleges there was no probable cause to detail him in the first instance, that he bore no similarity to the person being sought, and that he was racially profiled.
