United States v. Coiteux et al.

In May 2024, a jury convicted Tracy Coiteux of Conspiracy to Violate the Clean Air Act and 11 substantive violations of the Act. Coiteux and her husband routinely directed employees of their company to remove federally required pollution control hardware from diesel trucks and tamper with the OnBoard Diagnostic (OBD) devices to prevent them from recognizing the removal. While the case was on appeal, the government moved to remand in order to dismiss the case, having determined that prior criminal enforcement of CAA violations was "weaponization" by the Biden Administration.
