II. Whether Ms. Chattah can participate in and supervise the prosecution of the defendants pursuant to the Attorney General’s express delegation of that authority to Ms. Chattah in her capacity as First Assistant U.S. Attorney for the District of Nevada. Also, on the cross appeal, whether the defendant was properly indicted when Ms. Chattah was Acting U.S. Attorney for the District of Nevada
