United States v. Jackson

Defendant was indicted for a Hobbs Act violation for robbery and brandishing a firearm during a crime of violence. He moved to dismiss and to disqualify the office from prosecuting his case on the ground that the U.S. Attorney , Sigal Chattah, was illegally appointed. The district court granted the motion to disqualify Chattah, but denied the motion to dismiss, which decision the court stayed pending appeal to the 9th Circuit. The government appealed the order to disqualify, and defendant cross-appealed the order denying the motion to dismiss. The 9th Circuit upheld the district court.
