Pearson v. Callahan

United States Supreme Court; Case No. 07-751

Prior Decision

Opinion below 494 F3d 891 (10th Cir. 2007)

Argument(s)

Police officers may not enter and search a private home without a warrant based on the “consent” of a third party, a non-resident informant who purchased drugs there, and the search was so unreasonable that the officers are not entitled to qualified immunity from civil suit.
