We argue that the Stored Communications Act (SCA) has been misinterpreted as prohibiting “electronic communication service” providers, including social media companies, from divulging the contents of electronic communication and complying with defense subpoenas. Law enforcement does not have the same barriers to electronic communications. This imbalance has significant implications for defendants’ and their ability to advocate for themselves in criminal proceedings, especially as evidence obtained from social media is increasingly critical to their cases. Denying the defense access to this evidence is unconstitutional. It inhibits the amici’s ability to meaningfully defend their clients, it violates defendants’ right to due process, and circumvents judicial discretion.
