The Fifth Amendment Integrity Restoration Act (FAIR Act) — The FAIR Act (S.263, 2025) amends the federal criminal code to increase the federal government's burden of proof in civil forfeiture proceedings to clear and convincing evidence. It requires proceeds from the disposition of forfeited property to be deposited directly into the General Fund of the Treasury, rather than to Department of Justice (DOJ) accounts for law enforcement activities. The FAIR Act has bipartisan support and has been introduced in each session of Congress since 2015. NACDL wrote a letter to members of Congress urging them to support the FAIR Act.
