Detention and Due Process

NACDL seeks to curb the ever-expanding definition of terrorism and its impact on the criminal justice system while providing support to defense counsel throughout the country who must confront curtailment of fundamental constitutional rights under the rubric of national security. NACDL is working to challenge indefinite detention and military commissions at Guantánamo Bay, reform the Classified Information Procedures Act and overbroad material support statutes, and preserve due process and the requirements of Miranda v. Arizona for individuals arrested far from the battlefield.
