NACDL and Others Request DOJ Institute a Formal Rulemaking Process on the Issuance of Civil Investigative Demands
On July 13, 2009, NACDL and over two dozen other organizations submitted a letter detailing the problematic nature of the government's newly expanded ability to issue and utilize information gathered by Civil Investigative Demands (CIDs).
Specifically, the letter recommends certain policies and limitations that should govern the use of CIDs and requests that the Department of Justice institute a formal rulemaking process on the issuance of CIDs. While CIDs are civil investigatory tools, their use can have far-reaching ramifications on criminal investigations and third parties.
