Call Details: Last month, Judge Lewis Kaplan of the Southern District of New York held that the government violated the Fifth and Sixth Amendment rights of the defendants -- almost all of whom were former employees of KPMG accused of marketing unlawful tax shelters -- by implementing the part of the Thompson Memorandum that awards credit for cutting of attorney's fees to so-called "culpable" employees.

What is the reach of this decision to other cases and other practices, such as privilege waiver and bans on information sharing, that are endorsed in the Thompson Memo? What were the most difficult hurdles for the defendants to overcome? In what kinds of cases should such motions be brought, and what should they look like?
