Innovative DUI Trial Tools

Many of the jury selection suggestions in Innovative DUI Trial Tools are helpful, and author Bruce Kapsack explains how different types of jurors are receptive to different defense arguments. However, some of the specific questions he suggests about legal issues (e.g., proof beyond a reasonable doubt) will quickly draw objections. These objections will be sustained in more conservative jurisdictions, including the rural and suburban areas of west Georgia where this reviewer practices. His treatment of DUI-specific areas such as scientific evidence, motor skills, and nervousness may be of more utility to many practitioners.
That being said, the chapter on opening statements is definitely worth reading, while the chapter on cross-examination alone is worth the price of the book. Kapsack’s kinder, gentler approach to the arresting officer, which reflects a surprising solicitude for officer
